The relevant provisions of the Austrian Consumer Protection Act apply to consumers in Austria.<\/p>\n<p dir=\"auto\" data-start=\"946\" data-end=\"1149\">These Terms and Conditions apply to the booking and provision of our massage services and to the purchase of vouchers at our premises. They are displayed at our premises and are available on our website.<\/p>\n<p dir=\"auto\" data-start=\"1151\" data-end=\"1361\">Separate Online Voucher Shop Terms and Conditions apply to voucher purchases made through our online voucher shop. The voucher terms agreed at the time of purchase also continue to govern subsequent redemption.<\/p>\n<h2 dir=\"auto\" data-section-id=\"1dgvsm\" data-start=\"1363\" data-end=\"1388\">Data Protection (GDPR)<\/h2>\n<p dir=\"auto\" data-start=\"1390\" data-end=\"1610\">Information on the processing of personal data, particularly in connection with appointment bookings, treatments and voucher purchases, can be found in our <a class=\"decorated-link\" href=\"https:\/\/thaibalancemassage.at\/en\/privacy-statement\/\" target=\"_new\" rel=\"noopener\" data-start=\"1546\" data-end=\"1609\">Privacy Policy<\/a>.<\/p>\n<h2 dir=\"auto\" data-section-id=\"1ox9te0\" data-start=\"1612\" data-end=\"1640\">Bookings and Appointments<\/h2>\n<p dir=\"auto\" data-start=\"1642\" data-end=\"1719\">An order is placed through a booking made by telephone, in writing or online.<\/p>\n<ul data-start=\"1721\" data-end=\"3486\">\n<li data-section-id=\"put3sw\" data-start=\"1721\" data-end=\"1801\"><strong data-start=\"1723\" data-end=\"1734\">Prices:<\/strong> The treatment price agreed when the appointment is booked applies.<\/li>\n<li data-section-id=\"ftqx0e\" data-start=\"1802\" data-end=\"2607\"><strong data-start=\"1804\" data-end=\"1834\">Appointment cancellations:<\/strong> Appointments may be cancelled free of charge up to 24 hours before the scheduled appointment. In the event of a later cancellation or failure to attend, the Provider is entitled to charge the full treatment price as a cancellation fee, unless there is a substantiated compelling reason, such as illness supported by a medical certificate. Any expenses saved and any income earned elsewhere or deliberately forgone will be deducted from the amount charged. This also applies to treatments shortened due to late arrival. Statutory rights of withdrawal remain unaffected. Any invoiced cancellation fee must be paid within seven days. In the event of a dispute, the Provider reserves the right to substantiate its entitlement to the cancellation fee with appropriate evidence.<\/li>\n<li data-section-id=\"a5cdn\" data-start=\"2608\" data-end=\"2943\"><strong data-start=\"2610\" data-end=\"2641\">Repeated failure to attend:<\/strong> Customers who repeatedly fail to attend an agreed appointment or fail to cancel it in time may be temporarily or permanently excluded from making future bookings. The Provider reserves the right to exclude customers who repeatedly fail to attend without a valid excuse from receiving further services.<\/li>\n<li data-section-id=\"1qf47td\" data-start=\"2944\" data-end=\"3486\"><strong data-start=\"2946\" data-end=\"2963\">Late arrival:<\/strong> Customers who are running late are requested to inform us without delay. If a customer is up to 10 minutes late, we will attempt to provide the booked treatment in full. However, there is no entitlement to this. If a customer is more than 10 minutes late, the treatment time may be shortened accordingly. The full treatment price remains payable. If a customer does not attend the appointment without notifying us beforehand, the appointment may be allocated to someone else. The appointment cancellation provisions apply.<\/li>\n<\/ul>\n<p dir=\"auto\" data-start=\"3488\" data-end=\"3719\">The Provider will honor agreed treatment appointments wherever possible. If unforeseen circumstances make it impossible to keep an appointment, the Provider will inform the customer and agree a new treatment appointment with them.<\/p>\n<h2 dir=\"auto\" data-section-id=\"1xj8b09\" data-start=\"3721\" data-end=\"3737\">Force Majeure<\/h2>\n<p dir=\"auto\" data-start=\"3739\" data-end=\"4092\">If a treatment cannot take place due to force majeure, we will inform the customer. A replacement appointment will only be arranged by mutual agreement. For treatments that are cancelled without replacement, advance payments will be refunded or voucher entitlements already deducted will be reinstated, as applicable. Statutory claims remain unaffected.<\/p>\n<h2 dir=\"auto\" data-section-id=\"1j07ywa\" data-start=\"4094\" data-end=\"4115\">Prices and Payment<\/h2>\n<p dir=\"auto\" data-start=\"4117\" data-end=\"4242\">The price agreed when the appointment is booked applies to massage services. All prices include any applicable statutory VAT.<\/p>\n<p dir=\"auto\" data-start=\"4244\" data-end=\"4365\">Unless advance payment has been made or otherwise agreed, the treatment price is payable immediately after the treatment.<\/p>\n<p dir=\"auto\" data-start=\"4367\" data-end=\"4534\">Payment may be made in cash or using the debit and credit cards accepted at our premises. Valid vouchers will be credited in accordance with the terms agreed for them.<\/p>\n<p dir=\"auto\" data-start=\"4536\" data-end=\"4631\">In the event of technical payment problems, a payment period of up to seven days may be agreed.<\/p>\n<p dir=\"auto\" data-start=\"4633\" data-end=\"4714\">For online voucher purchases, the payment terms stated in the voucher shop apply.<\/p>\n<h2 dir=\"auto\" data-section-id=\"1s0fz0w\" data-start=\"4716\" data-end=\"4745\">Vouchers and Loyalty Cards<\/h2>\n<p dir=\"auto\" data-start=\"4747\" data-end=\"4824\">Vouchers are sold for a specific treatment or for a specified monetary value.<\/p>\n<p dir=\"auto\" data-start=\"4826\" data-end=\"5121\">Vouchers issued for a specific treatment duration may only be used for that duration. For example, a 60-minute voucher cannot be used for two treatments of 30 minutes each. No reimbursement will be made for a shorter treatment duration. A longer treatment duration must be paid for additionally.<\/p>\n<p dir=\"auto\" data-start=\"5123\" data-end=\"5290\">In exceptional cases, and following prior consultation, vouchers for a specific treatment duration may be redeemed for other treatments of the same duration and value.<\/p>\n<p dir=\"auto\" data-start=\"5292\" data-end=\"5648\">Vouchers issued in paper form must be presented in the original. Vouchers issued electronically may be presented digitally or as a printout. For electronic vouchers, the voucher code and the remaining balance or the treatment not yet redeemed, as applicable, determine the entitlement. Multiple printouts or copies do not create any additional entitlement.<\/p>\n<p dir=\"auto\" data-start=\"5650\" data-end=\"6131\">Service vouchers entitle the holder to the service specified on the voucher. For one year from the date of issue, the price of the service at the time the voucher was issued applies. After this year has elapsed, the difference to the current price must be paid upon redemption if the price of the service has increased since the voucher was issued. Alternatively, following consultation, the original voucher value may be credited towards another service of equal or greater value.<\/p>\n<p dir=\"auto\" data-start=\"6133\" data-end=\"6257\">Monetary-value vouchers remain valid for 30 years in accordance with section 1478 of the Austrian General Civil Code (ABGB).<\/p>\n<p dir=\"auto\" data-start=\"6259\" data-end=\"6773\">The loyalty card entitles the holder to exactly one free treatment after the number of treatments specified on the card. A separate loyalty card is used for each treatment duration (30, 60, 90 or 120 minutes). The duration of the free loyalty treatment corresponds to the duration of the previous treatments recorded on the card. No cash payment will be made in lieu of the free treatment. Loyalty cards are non-transferable. For loyalty cards newly issued on or after 1 January 2025, every 11th treatment is free.<\/p>\n<h2 dir=\"auto\" data-section-id=\"iln5rt\" data-start=\"6775\" data-end=\"6788\">Complaints<\/h2>\n<p dir=\"auto\" data-start=\"6790\" data-end=\"6917\">Please notify us of any complaints as promptly as possible. Statutory warranty rights and claims for damages remain unaffected.<\/p>\n<h2 dir=\"auto\" data-section-id=\"ou9bgc\" data-start=\"6919\" data-end=\"6933\">House Rules<\/h2>\n<ul data-start=\"6935\" data-end=\"7268\">\n<li data-section-id=\"1bek34m\" data-start=\"6935\" data-end=\"7008\">Smoking and alcohol consumption are prohibited throughout the premises.<\/li>\n<li data-section-id=\"nj2nl3\" data-start=\"7009\" data-end=\"7067\">Treatments are only provided to customers who are sober.<\/li>\n<li data-section-id=\"1jis9cb\" data-start=\"7068\" data-end=\"7109\">Pets are not permitted on the premises.<\/li>\n<li data-section-id=\"1nq8985\" data-start=\"7110\" data-end=\"7169\">Loud conversations and telephone calls are not permitted.<\/li>\n<li data-section-id=\"uefgdd\" data-start=\"7170\" data-end=\"7268\">In the event of serious breaches, the Provider may exclude the customer from further treatments.<\/li>\n<\/ul>\n<h2 dir=\"auto\" data-section-id=\"1ep98z6\" data-start=\"7270\" data-end=\"7282\">Valuables<\/h2>\n<p dir=\"auto\" data-start=\"7284\" data-end=\"7325\">The statutory liability provisions apply.<\/p>\n<h2 dir=\"auto\" data-section-id=\"3pnq4m\" data-start=\"7327\" data-end=\"7361\">Liability and Legal Information<\/h2>\n<p dir=\"auto\" data-start=\"7363\" data-end=\"7589\">The massages offered are intended solely for relaxation and maintaining good health and do not replace medical or therapeutic treatment. If you have any health complaints, we recommend consulting a doctor before the treatment.<\/p>\n<p dir=\"auto\" data-start=\"7591\" data-end=\"7632\">The statutory liability provisions apply.<\/p>\n<p dir=\"auto\" data-start=\"7634\" data-end=\"7870\">Direct billing to statutory or private health insurers is not possible. However, some health insurers offer contributions towards preventive measures under certain conditions. Please contact your health insurer directly for information.<\/p>\n<h2 dir=\"auto\" data-section-id=\"1ydymh1\" data-start=\"7872\" data-end=\"7910\">Place of Performance \/ Jurisdiction<\/h2>\n<p dir=\"auto\" data-start=\"7912\" data-end=\"7969\">The place of performance is Vienna. Austrian law applies.<\/p>\n<p dir=\"auto\" data-start=\"7971\" data-end=\"8028\">For consumers, the statutory rules on jurisdiction apply.<\/p>\n<h2 dir=\"auto\" data-section-id=\"1tqjku9\" data-start=\"8030\" data-end=\"8051\">Dispute Resolution<\/h2>\n<p dir=\"auto\" data-start=\"8053\" data-end=\"8208\">For complaints, please contact <a class=\"decorated-link cursor-pointer\" rel=\"noopener\" data-start=\"8084\" data-end=\"8157\">tutmirgut@thaibalancemassage.at<\/a>. The Provider reserves the right to change or expand the range of services at any time. Scope<\/h2>\n<p dir=\"auto\" data-start=\"8859\" data-end=\"9040\">These Terms and Conditions apply to the purchase of vouchers through the online voucher shop of Thai Balance Massage NBJ KG. Your contractual partner is Thai Balance Massage NBJ KG.<\/p>\n<p dir=\"auto\" data-start=\"9042\" data-end=\"9340\">Purchasing a voucher does not include the reservation of a specific treatment appointment. The <a class=\"decorated-link\" href=\"https:\/\/thaibalancemassage.at\/en\/terms-and-conditions\/\" target=\"_new\" rel=\"noopener\" data-start=\"9137\" data-end=\"9206\">General Terms and Conditions<\/a> for services provided by Thai Balance Massage additionally apply to subsequent appointment bookings and the provision of the massage.<\/p>\n<p dir=\"auto\" data-start=\"9342\" data-end=\"9563\">In the event of any conflict, these Online Voucher Shop Terms and Conditions take precedence over the general terms and conditions for services with regard to voucher purchases and the validity and redemption of vouchers.<\/p>\n<h2 dir=\"auto\" data-section-id=\"ukgyl2\" data-start=\"9565\" data-end=\"9601\">2. Ordering, Payment and Delivery<\/h2>\n<p dir=\"auto\" data-start=\"9603\" data-end=\"9690\">The display of vouchers in the online shop constitutes an invitation to place an order.<\/p>\n<p dir=\"auto\" data-start=\"9692\" data-end=\"9764\">By completing the ordering process, the customer places a binding order.<\/p>\n<p dir=\"auto\" data-start=\"9766\" data-end=\"9965\">The prices stated in the shop are final prices in euros, including any applicable statutory VAT. Payment is made at the time of purchase using the payment methods offered during the ordering process.<\/p>\n<p dir=\"auto\" data-start=\"9967\" data-end=\"10171\">Once payment has been successfully completed, the voucher will be provided by email without undue delay. There are no delivery charges. Please check the email address entered before completing your order.<\/p>\n<p dir=\"auto\" data-start=\"10173\" data-end=\"10306\">The contract for the voucher is concluded upon successful payment processing and electronic confirmation or provision of the voucher.<\/p>\n<p dir=\"auto\" data-start=\"10308\" data-end=\"10347\">The language of the contract is German.<\/p>\n<h2 dir=\"auto\" data-section-id=\"owsukl\" data-start=\"10349\" data-end=\"10377\">3. Redemption of Vouchers<\/h2>\n<p dir=\"auto\" data-start=\"10379\" data-end=\"10464\">Vouchers may be redeemed for the Nuad massage services we offer and are transferable.<\/p>\n<p dir=\"auto\" data-start=\"10466\" data-end=\"10741\"><strong data-start=\"10466\" data-end=\"10493\">Monetary-value vouchers<\/strong> are credited at their stated euro value towards the treatment price agreed when the appointment is booked. Partial redemption is permitted. Any remaining balance is retained. If the treatment price exceeds the balance, the difference must be paid.<\/p>\n<p dir=\"auto\" data-start=\"10743\" data-end=\"11468\"><strong data-start=\"10743\" data-end=\"10763\">Service vouchers<\/strong> specify a particular Nuad massage service and treatment duration and also state a voucher value in euros. A price guarantee applies to the specified service for one year from the date of issue stated on the voucher. If the treatment takes place within that year, no additional payment is required for that service as a result of any intervening price increases. If the voucher is redeemed later and the price of the relevant service has since increased, the euro amount stated on the voucher will be credited towards the price. Any difference to the current price must be paid by the customer. The one-year price guarantee does not limit the voucher\u2019s validity. The statutory limitation provisions apply.<\/p>\n<p dir=\"auto\" data-start=\"11470\" data-end=\"11669\">Electronic vouchers may be presented digitally or as a printout. The voucher code and the outstanding entitlement are decisive. Multiple printouts or copies do not create any additional entitlements.<\/p>\n<p dir=\"auto\" data-start=\"11671\" data-end=\"11811\">Vouchers cannot be redeemed for cash. Statutory rights to reimbursement, particularly in the event of a valid withdrawal, remain unaffected.<\/p>\n<h2 dir=\"auto\" data-section-id=\"fnnszx\" data-start=\"11813\" data-end=\"11827\">4. Validity<\/h2>\n<p dir=\"auto\" data-start=\"11829\" data-end=\"11917\">The statutory limitation provisions apply, generally providing for a period of 30 years.<\/p>\n<h2 dir=\"auto\" data-section-id=\"r1pfam\" data-start=\"11919\" data-end=\"11958\">5. Right of Withdrawal for Consumers<\/h2>\n<p dir=\"auto\" data-start=\"11960\" data-end=\"12158\">You may withdraw from your voucher purchase without giving any reason within 14 days of receiving the voucher. To do so, an unequivocal statement sent to the following contact details is sufficient:<\/p>\n<p dir=\"auto\" data-start=\"12160\" data-end=\"12351\">Thai Balance Massage NBJ KG, Gredlerstra\u00dfe 10\/1, 1020 Vienna<br data-start=\"12220\" data-end=\"12223\" \/>Email: <a class=\"decorated-link cursor-pointer\" rel=\"noopener\" data-start=\"12230\" data-end=\"12303\">tutmirgut@thaibalancemassage.at<\/a><br data-start=\"12303\" data-end=\"12306\" \/>Telephone: <a class=\"decorated-link cursor-pointer\" rel=\"noopener\" data-start=\"12317\" data-end=\"12351\">+43 1 386 51 80<\/a><\/p>\n<p dir=\"auto\" data-start=\"12353\" data-end=\"12424\">You may use the model withdrawal form below, but this is not mandatory.<\/p>\n<p dir=\"auto\" data-start=\"12426\" data-end=\"12547\">To meet the withdrawal deadline, it is sufficient to send your notice of withdrawal before the withdrawal period expires.<\/p>\n<p dir=\"auto\" data-start=\"12549\" data-end=\"12699\">In the event of a valid withdrawal, we will reimburse the payments received without undue delay and no later than 14 days after receiving your notice.<\/p>\n<p dir=\"auto\" data-start=\"12701\" data-end=\"12900\">We will generally use the same means of payment for the reimbursement as were used for the original payment, unless expressly agreed otherwise. You will not be charged any fees for the reimbursement.<\/p>\n<p dir=\"auto\" data-start=\"12902\" data-end=\"13373\">If the massage service is to be provided before the withdrawal period expires, the consumer must expressly request that the service begin early and acknowledge that they will lose their right of withdrawal once the contract has been fully performed. If the consumer withdraws after performance has begun but before the service has been fully provided, a proportionate amount must be paid for the service already provided, provided that the statutory requirements are met.<\/p>\n<p dir=\"auto\" data-start=\"13375\" data-end=\"13492\">Following a valid withdrawal, the relevant voucher or voucher code will be deactivated and can no longer be redeemed.<\/p>\n<h2 dir=\"auto\" data-section-id=\"f05id5\" data-start=\"13494\" data-end=\"13516\">6. Statutory Rights<\/h2>\n<p dir=\"auto\" data-start=\"13518\" data-end=\"13624\">These Terms and Conditions do not affect statutory warranty rights or any other mandatory consumer rights.<\/p>\n<h2 dir=\"auto\" data-section-id=\"z0rl2n\" data-start=\"13626\" data-end=\"13647\">7.
